Introduction
This Customer Purchase Agreement ("Agreement") governs purchases made through the Buddy Marketplace app ("Buddify", "Buddify Marketplace", "we", "us"), which facilitates transactions by providing a streamlined checkout interface that redirects customers ("Buyer," "you") to the seller's ("Seller") website for payment processing. By making a purchase through Buddify, you agree to this Agreement.
1. Transaction Processing
Purchases made via Buddify are completed on the Seller’s website. Buddify acts as a platform to connect Buyers with Sellers but does not process payments directly.
Although checkout occurs within the Buddify app for a seamless buyer experience, the actual payment and transaction processing are completed on the Seller’s website. You acknowledge and agree that your purchase transaction and payment processing are conducted on the Seller’s website, subject to the Seller’s terms and conditions.
You acknowledge that while Buddify aims to enhance the shopping experience, it is not directly involved in the payment or fulfillment of orders.
2. Product Listings and Descriptions
Sellers are responsible for providing accurate and complete product descriptions. Buddify does not guarantee the accuracy, completeness, or reliability of any listings.
3. Pricing and Payments
The Seller’s website will display the price of products, applicable taxes, and shipping costs. All financial transactions are conducted directly with the Seller.
Buyers are advised to review the Seller’s payment policies before completing a purchase.
4. Shipping and Delivery
The Seller is responsible for shipping and delivering the purchased products. Shipping terms, delivery times, and costs should be clearly stated on the Seller’s website.
Buddify is not responsible for any shipping or delivery issues but encourages Sellers to adhere to their stated shipping policies.
5. Returns, Refunds, and Exchanges
Return, refund, and exchange policies are determined by the Seller. Buyers should review these policies on the Seller’s website prior to making a purchase.
In case of disputes, Buyers are encouraged to contact the Seller directly to resolve the issue.
6. Dispute Resolution
Buddify facilitates communication between Buyers and Sellers but is not involved in the resolution of disputes arising from transactions.
Buyers and Sellers agree to resolve any disputes amicably and in accordance with the Seller’s dispute resolution policy.
7. Liability and Indemnification
Buddify is not liable for any loss or damage arising from the transactions between Buyers and Sellers.
Buyers agree to indemnify Buddify against any claims related to purchases made through the marketplace.
8. Amendments
Buddify reserves the right to modify this Agreement at any time. Continued use of the platform after such modifications signifies acceptance of the updated terms.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where Buddify operates.
Conclusion
By initiating a purchase through Buddy Marketplace, you, the Buyer, acknowledge that you have read, understood, and agreed to the terms of this Customer Purchase Agreement.
